All purchases placed with Bayside Performance in the store, by phone, online or email constitute the acknowledgement and acceptance of all terms and conditions listed below. All IP addresses will be recorded by Bayside Performance for each completed web transaction. In the event of a computer server/database technical problem which may cause discrepancies with our product pricing, shipping or sales tax calculations Bayside Performance will correct these discrepancies at the time of processing. The customer will be notified by Bayside Performance immediately in the event of these errors and the customer will have the option to continue with the purchase order with the corrected amount or cancel the purchase order without penalty. Bayside Performance will not be held responsible for any miscalculated totals due to server/database errors. All prices, product descriptions, availability, materials, design, color, contents included with the product and/or product specifications are subject to change without notice. Some products may be displayed with optional items that are sold separately.
Ideal store hours are 10am to 6pm Monday through Saturday. These hours are maintained throughout the riding season (March to September).
During fall and winter store hours will vary. We may close on Saturdays and/or Mondays without notice. We may close early or open late randomly on any day.
Bayside Performance specializes in custom order hard to get or made to order items. Our website does not and cannot state stocking levels. If you need to know stock before ordering you must contact us. We do stock the most commonly sold items and have a decent inventory however many items have to be sourced at the time of sale from many different distributors.
Parts Fitment Guarantee
Aftermarket parts do not always fit like OEM parts. Some aftermarket parts require modifications or fitment to work correctly. For example carbon fiber and race bodywork components often need trimming and modifications to fit correctly. Bayside Performance only guarantees fitment of these parts if they are installed by a licensed tech with experience installing aftermarket parts. Bayside Performance reserves the right to investigate each fitment issue and decide whether the part is incorrect or incorrect installation is the problem. The customer is responsible to install parts correctly or hire a company with the skills to complete the work properly. Please call us for more details.
Back Order Eta Process
Bayside Performance will notify the customer of any back ordered product longer than five (5) business days. Should your item be on back order you can chose to continue with the order or cancel it. Bayside Performance does not own or control the distribution of any supplier. Manufacturers and distributors reserve the right to cancel production and change delivery dates at any time. All back order eta's Bayside Performance quotes are estimates only based on what we have been told. Some back ordered items are made to order and can't be canceled or refunded once you approve the back order. Please call us for more details.
Continental USA purchases can be expected within 1-10 business days from the time of full payment, business days do not include weekends, holidays or distributor closures. International purchase orders can be expected within 6-14 business days from the time of full payment. If a customer has chosen an expedited shipping method, Bayside Performance does not guarantee that the purchase order will be shipped by a certain date. Some orders require "processing" time before the order is shipped. Estimated times of arrival (ETA) are estimates only and are not guarantees. Bayside Performance will give eta's at the time of order these eta's include the processing time before shipping. Once your order leaves our location you will be emailed automatically with your tracking number. If you feel your eta is to long you must contact us right away to make other arrangements. Distributors and manufacturers reserve the right to alter or change back order release dates at anytime.
Depending on the product ordered and the destination of the order, certain shipping services may not be available. Bayside Performance reserves the right to change the method of shipping suited to the product ordered and the destination of the package. Free shipping only applies to orders shipped in the Continental USA. USPS Priority Mail shipping rate will be added to your order if you select a free shipping product going outside of the Continental USA. The online store software is unable to correctly display shipping fees for free shipping items with pay shipping items when purchased at the same time. If you order a free shipping item with a pay shipping item at the same time and we can ship both items in the same box we would automatically refund the shipping costs. Free shipping helmet with pay shipping visor, we would refund shipping charge on the visor. If you order pay shipping tires with free shipping helmet you would still have to pay the shipping on the tires even if we can put helmet in the box with the tires.
Orders shipped outside the USA could be charged duty, brokerage or tax by your postal or customs agency. Customers must pay these fees if requested by these agencies when importing goods into their country.
Bayside Performance accepts Credit Cards, Cash, Debit E-transfer, PayPal, Money Orders, Certified Checks, Western Union and Wire Transfers. Purchases made by Credit Card and PayPal will only be shipped to a Verified billing address, unless other arrangements are made by contacting Bayside Performance in advance.Payments made by Money Order, Certified Check and Wire Transfer must be received in the full and cleared by our bank prior to Bayside Performance shipping any order.
Apparel Exchange/Return Policy
It is the responsibility of the customer to ensure correct and proper sizing when placing an order. There are no returns, cancellations or exchanges on any apparel, no exceptions. This includes apparel such as leather suits, jackets, pants, clothing, boots and gloves. If you have any questions regarding sizing, please refer to the manufacturers sizing charts or contact Bayside Performance for further assistance.

Product Exchange/Return Policy
If you would like to exchange a product, contact Bayside Performance within one (1) day upon the receipt of the sales order. All returns must be approved by Bayside Performance. Upon Bayside Performance approval for inspection of the returned product, Bayside Performance assigns a Return Authorization (RA) Number. The RA number is only for the product that Bayside Performance has approved for inspection.
Shipping costs of the returned product is the liability of the customer; Bayside Performance does not accept any collect on delivery (COD) shipments. The RA number must be clearly marked on the outside of the box; returns without the marked RA number will be refused and may be returned to the customer. All approved returns must received by Bayside Performance within ten (10) days of the RA number provided to the customer. Always send your item back USPS, UPS or FEDEX with tracking and email us the tracking number.
All returned merchandise must be in its original packaging with attached tags, instructions and in new condition. Both the product and packaging must be in new condition free from scratches, blemishes, tears or dents. It is the customer's responsibility to ensure the returning merchandise to Bayside Performance is adequately packaged, preventing any loss or damage to the returning product. Any parts that have been removed from the package or attempted to be installed are not returnable.
All claims for missing products must be made by the end of the next business day upon the receipt of the order, after that time Bayside Performance will not be liable for any shortages. All claims for damaged merchandise must be made to the shipping carrier; ensure that you keep all shipping cartons and all packaging materials for carrier inspection. It is the responsibility of the customer to initiate any claims with the carrier.
All returned merchandise to Bayside Performance is subject to a 20% restocking fee. All canceled orders are subject to a 20% restocking fee if the item has already been ordered in. Any purchases that are refused and returned to Bayside Performance are deemed non-deliverable and subject to a restocking fee, all shipping costs and possibly our final sale policy.
Shipping and insurance costs are non-refundable. If a refund is approved by Bayside Performance, the reimbursement of money will be issued to the customer in the same monetary form as the payment was made to Bayside Performance at the time of the purchase.
Bayside Performance makes no warranty, express or implied regarding any product that Bayside Performance sells. It is the responsibility of the customer to contact the manufacturer of your product for any warranty issues.
Bayside Performance is not liable for any death, injury, damages or loss resulting from the resale and/or use of any product sold by Bayside Performance. Bayside Performance is not responsible for and will not compensate customers for labor, installation, storage and/or other fees incurred by the customer as a result of the resale and/or use of any product purchased from Bayside Performance.
The products sold by Bayside Performance are intended for closed course use only. Alteration or modifications of a motorcycle from its stock or original manufacturer condition may increase the risk of accident or injury. Products sold by Bayside Performance are not intended for street or highway use. It is the sole responsibility of the customer to consult the federal, provincial/state and local regulations which may apply to alterations of your motorcycle.
